A contract for the services we offer must be concluded physically on site ( one cannot be concluded online).

I. SUBJECT
These General Terms and Conditions are intended to regulate the relationship between HOME PLUS BG Ltd, 1113 Sofia, D-r L.Rusev 24 str., hereinafter referred to as the Contractor, and the customers, hereinafter referred to as the Customers, on the website www.homeplus.bg.
Other terms and designations:
Client: Any natural or legal person who has requested a service through the website www.homeplus.bg using the technical means ( inspector request forms ) on the website.
Personal data: Any information relating to an individual who is identified or identifiable, directly or indirectly, by an identification number or by one or more specific attributes.
Processing of Personal Data: any act or set of acts that may be performed upon Personal Data, whether or not by automatic means, such as collecting, recording, organizing, storing, adapting or altering, recovering, consulting, using, disclosing or transmitting, disseminating, updating or combining, blocking, erasing or destroying the data.
Data Subject: Any natural person whose Personal Data is processed.

III. FEATURES
HOME PLUS BG Ltd operates the website https://homeplus.bg through which visitors are able to request an inspector from HOME PLUS BG Ltd.
IV. TECHNICAL STEPS FOR THE CONCLUSION OF AN AWARD CONTRACT
Contracting Authorities primarily use the interface of the www.homeplus.bg website to request an inspector to perform the Property Inspection Service. The contract for the property inspection service is concluded between the Employer and the Contractor on site ( it cannot be concluded online via the www.homeplus.bg website ).
The contract shall be concluded in Bulgarian.
The contract between HOME PLUS BG Ltd and the Client constitutes an agreement to these General Terms and Conditions, available on the website https://homeplus.bg.
The party to the contract with HOME PLUS BG Ltd is the Contracting Authority, which signs the award contract.
This contract shall be deemed to have been concluded from the moment of its physical signature on the spot.
Information about the property address to be inspected, the meeting place and the telephone number of the Employer of the service and the desired time of the visit shall be submitted via the form on the website, by email or on Viber.
When possible the Contractor shall accommodate the Client’s request for a desired visit time, if not another time suitable to the parties shall be agreed.
HOME PLUS BG Ltd shall explicitly notify the Client of the acceptance of the request for an inspector by appropriate electronic means – loading a page confirming the request for an inspector and/or an electronic message to the Client’s e-mail and/or, Viber or telephone number
Employers shall enter into the award contract with the Contractor physically when meeting on site ( not via www.homeplus.bg). Employers can request an inspector without registering by sending the address details of the property to be inspected, the meeting place, contact telephone number and the desired inspection time by e-mail, to the contacts listed on the https://homeplus.bg page or by Viber.
The website www.homeplus.bg is used for advertising and communication purposes and no sale of goods or services is made through it.
V. CONTRACTOR’S SPECIAL OBLIGATIONS. CONSUMER PROTECTION
The rules of this section of these General Terms and Conditions shall apply to Customers who, according to the data provided for the conclusion of the purchase contract, can be inferred to be consumers within the meaning of the Consumer Protection Act and/or the E-Commerce Act and/or Directive 2011/83/EC of the European Parliament and of the Council of 25 October 2011.
(1) The main features of the services offered by HOME PLUS BG Ltd are defined on the website www.homeplus.bg.
(2) The price of the services including all taxes is determined by HOME PLUS BG Ltd on the website https://homeplus.bg.
(3) The method of payment shall be by bank transfer to the account of HOME PLUS BG Ltd, IBAN BG07BPBI79421026721001, BIC BPBIBGSF upon receipt of a pro forma invoice to the email address provided by the Client.
(4) The information provided to the Purchaser under this section is up-to-date at the time of its display on the website of www.homeplus.bg prior to the conclusion of the Purchase and Sale Agreement.
(5) Purchasers agree that all information required by the Consumer Protection Act may be provided at www.homeplus.bg or by email.
(6) The Purchaser agrees that is entitled to accept payment in advance in connection with the inspection of properties.
(7) The Employer may exercise its right to cancel the request for an inspector by giving written notice to the Contractor, using the request form available at https://homeplus.bg., email or Viber. In this case, the Contractor shall forfeit the amount of BGN 100 and return the balance of the amount paid within 3 working days to a bank account specified by the Client.
(8) If the Contractor is unable to perform the contract due to being unable to visit the property subject to inspection, he shall notify the Employer of this within 6 hours before the scheduled appointment and refund the amounts paid by him.
(9) The Contractor shall submit the inspection report to the Employer after verifying that the requirements for providing information to the Employer under the Consumer Protection Act have been met.
(10) The Employer and the Contractor shall certify the circumstances referred to in subsection (9) in writing at the time of delivery of the report by handwritten signature, or by email, unless otherwise agreed. The message sent with the protocol attached to the mail address indicated by the Employer shall be considered as proof of delivery of the protocol.
(11) The Employer and the Contractor agree that the requirements of clause (9) will be complied with if the certification is made by a person who, in the circumstances, may be inferred to have communicated the information to the Employer, a party to the contract.
VI. VI. OTHER CONDITIONS
(1) The Contractor shall perform the service within the time period specified at the conclusion of the contract.
(2) The Employer shall review the inspection report and, if not in compliance, shall notify the Contractor immediately.
A contract shall not be deemed to have been awarded until it has been physically signed and payment has been received into the bank account specified on the website.
A request for an inspector may be cancelled by a phone call, accompanied by written notification, using the request form available at www.homeplus.bg or by email at info@homeplus.bg up to 6 hours prior to the scheduled property inspection appointment.
The inspection does not purport to monitor compliance with local building and remodeling laws or to determine what the sales or rental price is.
The inspector cannot advise on the purchase or lease of real property.
It is the Developer’s responsibility to provide access to the property for inspection.
If there is no access to a particular area, the inspector will note it on the report. This is not a reason for non-payment or reduction of the fee due.
Orders are accepted via the request form available on the website www.homeplus.bg”, by email info@homeplus.bg or by telephone.
Once you contact our consultant or one of our consultants contacts you and specifies what you would like the inspection to include, you will be quoted a price for the desired service. You should be issued with a pro forma invoice and make payment by bank transfer to the account of HOME PLUS BG Ltd. Upon receipt of payment, an original invoice will be sent to you and the order will be deemed accepted. An agreed day and time for the inspection should be specified. It is your responsibility to provide access to the property for inspection.
You can tell the inspector in advance or on site if you would like them to pay more attention to something specific.
The on-site inspector will take any photographs that are needed to support the information recorded in the report.
The result recorded in the report reflects the condition of the property at the time of the inspection.
The report can be obtained at the email address you provide or at the company office.
If questions arise after reviewing the Report, you may obtain clarification from the inspector.
Within 1 to 5 days after the visit, you will receive the Inspection Report. Its scope is directly related to the scope for your requested inspection and does not claim to be exhaustive with respect to other criteria.
If you are not satisfied with the result of the inspection, this is not a reason for refusal, non-payment or reduction of the fee for the service already carried out.
The inspector is not responsible for the condition of the property at the time of inspection or for changes occurring after the inspection.
The inspection is carried out according to strict criteria. After the inspector enters the report into the system, our inspector reviews it along with the photographic material and then certifies the report.
In addition to the inspection report. If you are a Seller or Tenant you also receive an Inspected Certificate and stamp which you can use on your advertisements or listings of the inspected property to attract the attention of customers. We can also upload the seal onto a photograph of the property provided by you.
The result of the inspection does not constitute investment or financial advice.
AMENDMENT AND ACCESS TO TERMS AND CONDITIONS
(1) These Terms and Conditions may be amended by HOME PLUS BG Ltd and all users will be notify at www.homeplus.bg.
(2) The User agrees that all statements made by HOME PLUS BG Ltd, in connection with the amendment of these General Terms and Conditions will be sent to the e-mail address indicated by the User when completing the request form.
(3) The Contractor shall publish these General Terms and Conditions on its website together with all amendments and modifications thereto.
TERMINATION
These General Conditions and the Contracting Authority’s contract with the Contractor shall be terminated in the following cases:
Upon the dissolution and liquidation or bankruptcy of either party to the contract;
By mutual agreement of the parties in writing;
Unilaterally, by notice from either party in the event of default by the other party;
In the event of objective impossibility of either party to the contract to perform its obligations;
In case of seizure or sealing of the equipment by governmental authorities;
In the event of deletion of the Personal Data of the Customer requested by www.homeplus.bg
In this case, the concluded but not executed procurement contracts shall remain valid and enforceable;
All disputes between the parties under this contract will be resolved by the competent court or the Consumer Protection Commission.
